On 10 September 2026, the High Court refused Sall Grover and Giggle for Girls special leave to appeal the Full Federal Court's ruling in Giggle v Tickle, ending their final avenue of appeal in Australia. The ruling found that Sall and Giggle unlawfully discriminated by excluding a biological male who identifies as a woman from their female-only app.
For women and girls, the consequences reach beyond one app. The decision exposes the uncertainty facing anyone seeking to maintain a female-only space, service or activity on the basis of biological sex.
The courts have interpreted the law Parliament gave them. Now Parliament must fix it: it must amend the Sex Discrimination Act to restore clear protections for women and girls on the basis of biological sex.
That was our message when supporters gathered outside Parliament House in Adelaide on 25 July 2026 for Women’s Forum Australia’s Fix the SDA rally.
Sall joined advocates, families and elected representatives to call for clear laws that protect women’s safety, privacy, dignity and fairness in female-only spaces, services and sport.
